EXECUTIVE SUMMARY:
The applicant was discharged for Pattern Of Misconduct in 2012.

The applicant began an inappropriate relationship with a subordinate at a smaller unit of less than 65 personnel.
After being awarded Non-Judicial Punishment (NJP) in 2011, the applicant was specifically ordered to stop all
contact with the co-worker outside of the workplace. Just months later, the applicant continued pursuing the
same prohibited relationship on social media. Thus, this resulted in another NJP proceeding for the same
offense. Due to this being 2 NJP’s within 24 months, the command began processing the applicant for
Discharge for a Pattern of Misconduct.

The Board finds no issues with propriety or equity in this case. The applicant received an Honorable Discharge
based on the entirety of his otherwise acceptable 4 years and 9 months of service.

Propriety: Discharge was proper.
Equity: Discharge was equitable.
Final Adjudication by Assistant Commandant For Human Resources: No relief.

In the Fall of 2002, the applicant was found guilty at NJP for illegal use of the government credit card, and assaulting/threatening a fellow Petty Officer. However, the character of service standard for separations with the SPD code of JKN normally results in an Under Honorable Conditions discharge. The reason of Frequent Involvement of a Discreditable Nature is not an official Narrative Reason to be used on the DD-214.

The applicant was counseled and taken to NJP for larceny in the Spring of 2001. Therefore, the board recommends relief based on the consistency of these separations, and noting that the JKN code was established to separate individuals for a pattern of misconduct stemming solely from minor disciplinary infractions. Also of note, from an administrative standpoint, the board notes the inconsistency of the applicant’s Entry Into Service Date on the DD-214 worksheet.
